Q: Why is eBay's 30-day limit on pre-sales important?

Some eBay sellers have started auctions for Simpsons exclusives and other items that are not scheduled to be shipped within 30 days . This is a violation of eBay's Pre-sale Listings policy, as quoted here:

A seller who lists a "pre-sale" item on eBay must clearly indicate within the listing the fact that the item is a pre-sale item and a delivery date that indicates the item will be shipped by the 30th day from the end date of the listing. Additionally, this text must be HTML font size 3 (at a minimum.) eBay will end any listing that is a pre-sale, which does not include this information.

EBay also includes the following stipulation on their Prohibited, Questionable & Infringing Items page:

Even if you offer to give away for "free" (rather than sell) a prohibited, questionable, or infringing item, this will not relieve you of potential liability. This applies to both seller and buyer.

EBay will shut down these auctions if you report them. If the seller promises an inaccurate delivery date within 30 days, you may need to include evidence from the manufacturer or exclusive retailer of the actual shipping date. We suggest you send a message like the following one to eBay Contact Rules & Safety:

I am writing to report that this auction is in violation of eBay's 30-day delivery limit on pre-sells:

(insert auction title and number here)

(mention the seller's improper delivery date, the seller's lack of a stated delivery date, or outside information showing the item cannot be delivered within 30 days here)

As quoted from eBay's policies, eBay is supposed to remove this auction to protect the buyer:

"A seller who lists a "pre-sale" item on eBay must clearly indicate within the listing the fact that the item is a pre-sale item and a delivery date that indicates the item will be shipped by the 30th day from the end date of the listing. Additionally, this text must be HTML font size 3 (at a minimum.) eBay will end any listing that is a pre-sale, which does not include this information."
